Do they pay out even below the treshold if I close my account now?

Good question, I would like to know that too.
Do they pay out even below the treshold if I close my account now?

Good question, I would like to know that too.

I asked this question on numerous occasions to different emails of theirs and never received a reply.

So I wrote about the experience.

Received a reply this weekend, not surprisingly it's exactly the answer I didn't want to hear:

"Hi
You would forfeit any earnings accumulated, by closing your account. Additionally the files are permanently deleted and you could not reopen the account at a later time.
Kind regards"

But if they honestly do delete all your files, instead of leaving them up for sale on partner sites, that might be worth the gift of the lost earnings?

WOW, YAY!

In the first part Yay shows that to many contributor closed their accounts.

In the second part they show that they are looking for MORE photos which will be sold anywhere without paying contrigutor, because it is their own fault not uploading new images. And we know what Yay is doing with closed accounts: Still selling and not paying.

Here is the email i got and for sure many of you, too. Just to warn all sleeping contributor, who until now did not realise whats going on on Yay now.

Hello

Yay's May contributors promotion is here. Upload 2000 approved image or vector files during the month of May & we will add a bonus deposit of $10 to your contributor account. Please note that video files are not included in this promo.

How does it work?

Upload your high quality image or vector content via ftp
Ensure your files are properly tagged with metadata
Submit the files before the end of May.
Wait for your file's approval. Remember that you must have 2000 image or vector files approved for the bonus to be appled.
Your $10 bonus will be deposited shortly thereafter

What you can upload
Images
Model released Images
Vectors
Icons
Backgrounds

Upload Your Files

You can find the full image/vector intake documentation here:
https://contributors.yayimages.com/documentation/images

Notice of deletion for inactive accounts

Please note that after the promotion has ended, as part of our effort to modernize the content of our marketplace, we will be deleting or cancelling accounts with no recent upload activity for the previous 2 years. This will be done at our own descretion. If you have not uploaded, submitted, and had a file approved during the last 2 years your account will be at risk of deletion, cancellation & any pending balance owed will be reset or forfeit.

Please reach out to us at [email protected] for any questions or suggestions you may have regarding uploading new files.

Kind regards,
YayImages Team

I'm leaving as soon as I've cashed out my money. Scary, malevolent agency.

Phew I don't come here much often now, and wow didn't really notice all this crap, I just noticed increased earnings from Yay. I still have the Skype contact of the ''new owner'' at Yay as I initially uploaded my portfolio on their ''new opening'' but I knew nothing about all this Depositphotos crap and fake partner sites. The way we see our earnings we have no way of knowing if the sales are accurate or where they come from. I sure never agreed to have my portfolio up on Depositphotos when my images are already there in the first place, so they are competing my own images!.

I'll contact them and dig into it but if nothing moves on my side I will take legal actions. If I go that way I'll let you know here in case we can voice our claim together

Please. I am also stopped to upload but haven't deleted anything or closed account since it seems futile for now. Let us know please.

For now I contacted Depositphotos legal department and ask that all my images that are under their names be removed, and also contacted Yayimages about it. I am yet to receive and answer from Yay. I will give them a few weeks to respond then if no answer I'll send them a letter via a international lawyer from their own country to see if they take this seriously. That's the first steps I'll take for now in the following weeks. Will keep posted here on any development.

GDPR is a bluff mostly. The data sold and resold and real privacy is a fiction. But - who has a juridical education - please comment - can we employ these laws to ensure deletion of our content? The content, names and copyright are related.

Btw how can we make sure deposit delete the files. Apparently yay submitted with their own name not contributors. I mean how is it possible to detect among 1.2 million images. Is it our "job" to find each with links etc? What do you think?

They need to just delete the whole portfolio. It is clear that it is being run by someone without any permission or connection to the copyright holders of the images. YAY say they have no connection to the acount anymore!!

Hmm. I am not sure. 2.5 million is a huge number, they most likely won't want to since they accept whatever you submit because the company wants to increase the quantity of products on website and this will continue for a long time I believe. Only a legal trouble makes them think I guess, how and when, no idea.

I agree with this. Wow Yay said this? It means it might be from the old management of Yay and they kept those old account active without any payment... wow.

I contacted Depositphotos support as I have over 100k illustrations there and they say they are looking into it seriously and will update me. I sugged that anyone who see their images on the Yayimages account on Depositphotos contact their support with subject IMAGE STOLEN! and show a few example of your image and the duplicate image in the Yay account. The more support request they receive, the more pressure they will have.

In any case if nothing moves on Deposit then we can have legal action there also, but I think just having a lot of pressure on Deposit to remove this account should work well.

This is reasonable. The more the people. I will dig my images and inform them.

oh, your case is even worse. Sorry. Let us know please if they get back to you. Yay most likely won't care but at least deposit might hear another problematic case by yay.

Deposit sent a generic email response saying they opened a ticket. Thats all so far. I gave them the image # for sale on Adobe so they can check. I told them they needed to boot yaymicro for copyright violations.

Likewise. But for now we could only do this I think, at least keeping pressure might be a fast-solution in the short term. Let's see what will happen after a while.

Just an update...deposit did remove the page with my image where you can buy it. However, the preview image still shows in yayimages account.

I will go look on yayimages to see if its off their site. I never even heard back from them. ETA: dont see it on yay either. Ill have to periodically check. These people are scum.

Thanks for doing this. Deposit answered me... and removed the 2 images I used as reference, but I have THOUSANDS of images there.

Also someone pointed out that Yayimages says they do not have any links to this portfolio anymore. That's a lie, as new management was there when my images we're uploaded. You can notice the UPLOAD DATE on the Depositphotos page, some of mine are there since Feb 11, 2020.

I am now writing a last email to Depositphotos to request not only that they remove my image, but that they CLOSE the account altogether. How can they think it's satisfying to have image per image removed when that portfolio been making money on our back since a while. I will give them 7 days to close the portfolio.

I prefer not engaging legal fees but it would be really stupid on their side to keep that portfolio live to the public when it's clearly stolen work. What is funny is that I point my images on my portfolio, then the stolen image on Yayimages, and they act as they protect the thief and only remove the image. Other agencies would outright close the portfolio and have no tolerance on copyright infringement. :-/.

This is the email I sent to them (to Depositphotos), should make them move in the right direction (delete that portfolio):
Quote
No they are not I sent you 2 reference images. There are THOUSANDS of my images there. There are also many other contributors who reports the same thing in a forum. You should close this portfolio altogether. The Yayimages agency also reports that this portfolio is no theirs, so this is clearly stolen work that no contributors are getting paid for.

You do not seem to take this seriously. I do. It seems you are looking to protect the thieves AND let them have our money, for years! I give 7 days to REMOVE the Yayimages thief portfolio before I engage legal actions. I also request that you return the earnings that have been stolen to the right contributors. I have reports of other contributors also contacting you about their stolen work, and you seem to be hand in hand with the thief by protecting them. If so then you will face the same legal actions.

Shutterstock would have done legal action AGAISNT the thief, Adobe Stock, iStock all other agencies also.

Do you really want me to send a list of at least 20 000 of my stolen images in this email Its pretty easy. Click my images in their portfolio, then my image is in the Similar Royalty-free vectors section Here we go:

- https://depositphotos.com/344546324/stock-illustration-macon-heart-georgia-georgia-1890s.html (my image is here: https://depositphotos.com/6751266/stock-illustration-macon-or-heart-of-georgia.html )
- https://depositphotos.com/344542590/stock-illustration-manx-vintage-engraving-old-engraved.html (my image is here: https://depositphotos.com/6723024/stock-illustration-manx-vintage-engraving.html )
- https://depositphotos.com/344545616/stock-illustration-green-tailed-jacamar-galbula-galbula.html (my image is here: https://depositphotos.com/6748106/stock-illustration-green-tailed-jacamar-or-galbula.html )
- https://depositphotos.com/344547068/stock-illustration-garden-sorrel-rumex-acetosa-common.html (my image is here: https://depositphotos.com/6755814/stock-illustration-garden-sorrel-or-rumex-acetosa.html)
- https://depositphotos.com/344546392/stock-illustration-purple-mangosteen-garcinia-mangostana-mangosteen.html (my image is here: https://depositphotos.com/6751888/stock-illustration-purple-mangosteen-or-garcinia-mangostana.html )
- https://depositphotos.com/344541792/stock-illustration-banyan-ficus-benghalensis-vintage-engraving.html (my image is here: https://depositphotos.com/6717070/stock-illustration-banyan-or-ficus-benghalensis-vintage.html )
- https://depositphotos.com/344542902/stock-illustration-coconut-coconut-palm-cocos-nucifera.html (my image is here: https://depositphotos.com/6726212/stock-illustration-coconut-or-coconut-palm-or.html )

And the list goes on and on. Same with my color vectors:
-   https://depositphotos.com/347650818/stock-illustration-man-pain-tibia-vector-illustration.html (my image is here: https://depositphotos.com/16907979/stock-illustration-man-in-pain-illustration.html )
-   https://depositphotos.com/347654230/stock-illustration-mine-worker-using-chisel-hammer.html (my image is here: https://depositphotos.com/16202051/stock-illustration-mine-worker-illustration.html )
And thousand more there also!

If you want me to send the exact list of all my stolen images I can ask a programmer to scrape your site and send you the list of all the COPY/DUPLICATE files with the same title/filename but since you have millions the scrape will work long. I will charge you 500$USD for this work to be done, plus my time to work on protecting my images when that is supposed to be the agencies work.

Waiting for a serious response this time.
